By registering an account, accessing our website, or utilizing any services on either our Certificate Management Portal or Digital Agency Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. User Account Creation, Dual-Portal Access, & Security
1.1 Account Creation & Eligibility
To access the specialized features of OurFatah, you must register and create a user account. By registering, you warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and capable of entering into a binding legal contract. You agree to provide accurate, current, and complete profile information at all times.
1.2 Dual-Portal Architecture
OurFatah operates a dual-portal system to serve two distinct administrative and technical service needs. A single set of registered login credentials grants you authorized access to:
- The Certificate Management Portal: Designed for preparing, submitting, tracking, and retrieving state and central government document applications (such as Income, Domicile, and Caste certificates).
- The Digital Agency Portal: Designed for initiating web development projects, reviewing UI/UX layouts, managing agency deliverables, and tracking service invoices.
You agree to use each portal strictly for its designated purpose. Misuse of the dual-portal infrastructure—including attempting to route agency development requests through the certificate portal or vice versa—may result in immediate account suspension.
1.3 System Security & Infrastructure
OurFatah employs industry-standard security protocols, including secure PDO-based database connections, parameterization, and encrypted data transmission, to protect account data against unauthorized access, SQL injection, and cyber threats.
1.4 User Security Obligations
You are solely responsible for maintaining the confidentiality of your credentials. You agree to:
- Maintain password confidentiality and refrain from sharing credentials with third parties.
- Notify OurFatah immediately of any unauthorized account access or security breach.
- Accept legal responsibility for the authenticity of all documents uploaded via your account.
2. Streamlined Document & Certificate Management Services
2.1 Intermediary Status
OurFatah acts strictly as a digital facilitator and administrative intermediary. We assist users in the formatting, preparation, and submission of applications for official documents to respective state revenue portals (including Uttar Pradesh e-District) and central authorities. OurFatah is an independent service platform and is not affiliated with, operated by, or an official arm of any government entity.
2.2 Government Discretion & Processing Timelines
While OurFatah streamlines application preparation and provides automated status notifications, the final verification, physical inspection (e.g., by local revenue officers or Lekhpals), and final approval or rejection of any application rest entirely with the issuing government authority. Estimated processing timelines are based on standard departmental workflows and cannot be guaranteed.
2.3 User Responsibility for Document Authenticity
You are solely responsible for ensuring that all identity proofs, address proofs, income records, and self-declarations uploaded to the portal are genuine, complete, and legally valid. Submission of forged, altered, or fraudulent documents will result in immediate service termination, permanent account ban, and potential reporting to law enforcement authorities under applicable legal statutes.
3. Web Design & Digital Agency Services
3.1 Scope of Digital Work
Digital agency services—including custom website design, web application development, database architecture, payment gateway integration, and API setup—are rendered according to the specific project scope agreed upon within the Digital Agency Portal.
3.2 Client Assets & Intellectual Property
- Client Assets: You retain ownership of all original text, trademarks, and media assets provided to OurFatah for inclusion in your project. You warrant that you own or hold appropriate licenses for all submitted content.
- Deliverables Ownership: Upon full payment of all contractual fees, intellectual property rights to custom frontend layouts, tailored backend scripts, and final code bases developed specifically for your project transfer to you, excluding pre-existing core frameworks, open-source modules, or proprietary agency components.
3.3 Revisions & Scope Changes
Additional functionality, layout overhauls, or features requested outside the initial project scope outlined in your portal contract will be billed separately as per our current agency rates.
4. Payment Gateway Terms, Invoicing, & Refund Policy
4.1 Payment Gateway Processing
OurFatah integrates secure, PCI-DSS compliant third-party payment gateways (including Razorpay) to handle service fees, government fees, and agency invoices. By making a payment on the platform, you authorize our payment partners to process your transaction credentials via UPI, credit/debit cards, or net banking. OurFatah does not store raw credit card numbers or UPI PINs on its servers.
4.2 Fee Structure
- Certificate Services: Fees displayed consist of the official government application charge combined with OurFatah’s platform convenience and administrative handling fee.
- Digital Agency Services: Fees are structured via milestone-based payments, deposits, or itemized invoices generated within your client dashboard.
4.3 Strict Refund Policy
- Certificate Applications: Because administrative review and submission workflows begin immediately upon payment, all fees are strictly non-refundable once an application has been processed or submitted to the relevant government portal, regardless of whether the issuing officer approves or rejects the certificate.
- Agency Services: Project deposits and completed milestone payments are non-refundable once work on the corresponding project phase has commenced.
5. Automated Communications & Notification Consent
5.1 Express Consent for Electronic Alerts
By creating an account or placing an order, you grant express affirmative consent to receive automated operational notifications from OurFatah via SMS to your registered mobile phone number, Email to your registered address, and Instant Messaging (including WhatsApp), where enabled.
5.2 Scope of Operational Alerts
Notifications sent to you include One-Time Passwords (OTPs), account security alerts, application tracking milestones (e.g., submission, deficiency flags, certificate ready for download), project completion notices, and Razorpay billing invoices.
5.3 TRAI / DND Registry Override
By submitting your phone number to OurFatah, you explicitly authorize OurFatah and its verified messaging API partners (such as MSG91) to send operational and transactional SMS messages. You acknowledge that this request explicitly overrides any registration on the National Customer Preference Register (NCPR) or Do Not Disturb (DND) registries managed by telecom authorities.
5.4 Opt-Out Mechanics
- Marketing Communications: You may opt out of promotional communications at any time using the "Unsubscribe" link in marketing emails or through your account notification settings.
- Transactional Messages: You cannot opt out of critical security, application tracking, or billing alerts while you have an active account or pending application on OurFatah.
6. Data Collection, Processing, & Privacy Rules
6.1 Compliance Framework
OurFatah collects and processes digital personal data in compliance with applicable Indian privacy laws, including the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection (DPDP) Act, 2023.
6.2 Data Categories Collected
We collect:
- Identity & Residency Information: Full name, DOB, gender, Aadhaar, Voter ID, and address records required for government document issuance.
- Contact Data: Phone numbers, email addresses, and physical communication addresses.
- Financial Metadata: Razorpay transaction reference numbers, order IDs, and payment status flags.
- Technical Data: IP addresses, browser specs, device logs, and access timestamps captured to maintain portal security.
6.3 Lawful Data Sharing
Your data is never sold, rented, or commercialized. Data is shared strictly on a need-to-know basis with:
- Government Authorities: State revenue departments, Tehsildars, and verified administrative systems processing your requested applications.
- Technical Processors: Verified technology partners (Razorpay for payments, MSG91 for SMS delivery, secure cloud hosting providers) operating under strict contractual confidentiality standards.
- Statutory Bodies: Legal or regulatory authorities when compelled by court order, law enforcement, or statutory mandate.
6.4 Data Security & Principal Rights
We utilize encrypted transit protocols, sanitized database layers, and strict administrative access controls to safeguard your personal data. Under applicable law, you retain the right to review your stored personal data, request corrections to inaccurate profiles, or file grievances regarding data handling with our designated Grievance Officer.
7. Prohibited Activities
Users agree not to engage in any of the following activities on OurFatah:
- Uploading fraudulent, forged, altered, or deceptive government identity proofs.
- Attempting to reverse engineer, decompile, or compromise the website source code, database scripts, or security layers.
- Transmitting malicious code, web crawlers, or automated bots designed to scrape portal data.
- Using the agency portal to upload content that infringes upon third-party copyrights, trademarks, or publicity rights.
- Harassing, abusing, or threatening administrative support staff or technical agents.
8. Disclaimers & Limitation of Liability
8.1 Service Provided "As-Is"
OurFatah provides its portal services on an "As-Is" and "As-Available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 Limitation of Damages
In no event shall OurFatah, its administrators, developers, or affiliates be liable for any indirect, incidental, consequential, special, or punitive damages—including lost profits, loss of data, government rejections, legal penalties, or business interruption—arising out of your use or inability to use the platform. Our maximum cumulative liability for any claim shall not exceed the amount paid by you to OurFatah for the specific service giving rise to the dispute.
9. Governing Law & Dispute Resolution
These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. Any legal action, dispute, or proceeding arising out of or relating to these Terms, the Certificate Portal, or the Digital Agency Portal shall be subject to the exclusive jurisdiction of the competent courts located in Lucknow, Uttar Pradesh, India.

10.1 Updates to Terms
OurFatah reserves the right to modify or replace these Terms at any time. Material changes will be communicated via portal announcements or email alerts. Continued use of the platform following any modifications constitutes acceptance of the updated Terms.
